2007 OPAA Spring Training
April 12 & 13, 2007

This year's Spring Training Seminar will include a potpourri of subjects, but concentrating on three broad areas: trial techniques and witness evaluation; cyberstalking and domestic violence; and an introduction to the new forfeiture statutes. Something for everyone, from new assistants learning trial techniques to the jack-of-all-trades who needs to be up to speed on a broad range of subjects, including fraudulent resident cards and the new forfeiture bill.

10:00 - 11:00 Myth Busters Meets CSI
An experienced trial lawyer will impart his experience from 20-plus years of trying all kinds of cases. Juergen will give a quick tour de force of trial techniques, discussing voir dire, direct and cross examination, argument, and will pass on tips for the new assistant on putting forward the best case and persuading the jury to your point of view.

11:15 - 12:15 Evaluating Witness Demeanor
During this presentation you will learn the verbal and nonverbal behavior symptoms that are displayed by a person who is telling the truth during a non accusatory interview, as well as those displayed by a person who is withholding relevant information. The specific behaviors discussed include attitude, posture, significant posture changes, grooming, personal and protective gestures; eye contact, and verbal responses.

In this presentation we will discuss the frequency of false confessions; the experts who testify in false confession cases and their positions; the elements which contribute to false confessions; and, the role of electronic recording to protect against false confessions.

Stalkers are using much more than the internet. New communications and wireless technologies are being put to use by stalkers. This session will introduce those technologies, and using real-world examples, explain how stalkers are using them to commit their crimes.

10:45 - 12:00 Prosecuting Domestic Violence in the Post-Crawford-Age
Saying that the Crawford case changed how we prosecute domestic violence is like saying Krakatoa went poof. This session will review the recent Confrontation Clause holdings, and focus on how to success- fully prosecute domestic violence cases, focusing on using the doctrine of forfeiture by wrongdoing, and innovated trial and investigative techniques.

2:15 - 4:15 Asset Forfeiture Reforms under H.B. 241
Based on proposals developed by the Ohio Criminal Sentencing Commission, H.B. 241 (sponsored by Rep. Bob Latta) is designed to make Ohio's asset forfeiture law easier to understand, more consistent, and fairer. The bill takes effect July 1, 2007. The presentation will cover all the substantive changes made by the bill including the new Revised Code chapter governing forfeitures, changes in pre- and post-trial procedures, and the rights of the state or subdivision seeking forfeiture and of persons whose property is subject to forfeiture.

OPAA HAS REQUESTED SUPREME COURT APPROVAL OF 10.75 HOURS OF CLE CREDITS.

The room rate at the Hyatt on Capitol Square is $133.00 for single or double occupancy. To make reservations, call 614-228-1234. Tell them you are with OPAA to obtain our rate. The cut-off date for our block of rooms is March 21st.

Hotel check-in time is 3:00 p.m., and check-out time is 12:00 noon.

The registration fee is $200.00 for both days. This covers all handout materials, continental breakfasts, breaks, and lunches on both days. The fee for one day only is $125.00. Due to the expense of producing the training manual, a $40.00 penalty will apply to all cancellations made through April 6th, and a copy of the manual will be sent. To help defray the cost of food guarantees, cancellations after April 6th will be assessed a $100.00 penalty if scheduled to attend both days, and a $75.00 penalty if scheduled for one day only. Please send registrations to OPAA by April 4th (earlier if possible).
