2024 OPAA SUMMER WORKSHOP
June 21st – 22nd, 2024

We once again will be meeting on the shores of Lake Erie to educate the membership and to enjoy the other activities the area provides. As usual, we will provide both a criminal law track and a civil law track. The criminal side will have presentations on juror misconduct or tampering; an overview of the Organized Crime Investigations Commission; forensic anthropology; and a sexual assault protocol update and House Bill 33. On the civil side we will explore social media and the First Amendment; what to expect for the November election and how the Secretary of State can help with issues; how recreational marijuana will affect public employers; and problems and responses for public employers and First Amendment auditors, discipline, off-duty misconduct, and more! We look forward to seeing all of you at Cedar Point!

9:00 – 10:30 The Alex Murdaugh Case: Responding to Allegations of Juror Misconduct or Jury Tampering
Alex Murdaugh was convicted of Murder, and he filed a motion for new trial alleging that the clerk of courts tampered with the jury by advising them not to believe Murdaugh’s testimony and pressuring them to reach a quick guilty verdict. After an evidentiary hearing where a juror indicated they were influenced by the clerk to return a guilty verdict, the judge overruled the motion finding that there was insufficient evidence to overturn the jury’s verdict. In this presentation, we will examine the Murdaugh case, Ohio law on jury misconduct, and how the State can respond to allegations of juror misconduct to prevent a reversal of a conviction or the granting of a motion for new trial.

The Organized Crime Investigations Commission assists local law enforcement agencies in combatting organized crime and corrupt activities. The Commission is composed of members of the law enforcement community and is chaired by the Ohio Attorney General. This presentation will look at the various programs to assist county prosecutors in dealing with
complaints of organized crime, corrupt activities, and monitoring current investigations as well as an overview of the commission.

9:00 - 10:30 Social Media and the First Amendment
A look at the law, including the recent SCOTUS decision in Lindke v. Freed, which answers the age-old question: when can I delete this annoying Facebook comment? Over the last decade, federal courts have struggled to adapt a century of First Amendment jurisprudence to the phenomenon that is social media. This presentation will provide an overview of how the law sits today. Focus will be on when government agencies can moderate content on social media pages and when moderation may violate the First Amendment. We’ll discuss forum analysis briefly and spend most of our time with several types of speech that are or are not protected by the First Amendment.

This presentation will look at the resources available to prosecutors including directives, advisories, and other items you may need to get through the general election season later in the year. We will also take a look at HB458 and look at issues counties have had and how best to deal with them should they show up again.

This presentation will introduce the field and Forensic Anthropology and the ways a Forensic Anthropologist can contribute to a death investigation. Three main learning objectives will be addressed using case studies: 1:The recovery of human remains from the death scene, 2: The identification of human skeletal remains and 3: Analyzing human skeletal remains for trauma. The importance of training and communication between agencies will be emphasized.

9:00 - 10:30 Navigating the Green Transition: Impact of Issue 2 / §3780 on Public Employers in the Shifting Landscape from Medical to Recreational Marijuana
In November 2023, Ohio voters enshrined adult recreational marijuana use into Ohio Law. This presentation will dive into the nuances of the newly enacted §3780 of the Ohio Revised Code and how civil servants and employers can navigate their questions and concerns involving how recreational marijuana may affect the public workplace. Further discussed in this session will be the powers and rights public employers hold to separate adult recreational marijuana use from the workplace and how to manage instances of the activity creeping into the workplace.

10:45 - 12:00 The Twists, Turns, Screams and Thrills Awaiting Around Every Corner of Public Employment
This presentation will review a variety of risks facing public employers on a seemingly daily basis. In addition to reviewing the ongoing issues faced by various officeholders, this presentation will address the appropriate responses to be taken. During the presentation, discussions will be had regarding responding to First Amendment Auditors; disciplining employees for off-duty misconduct; responding to inappropriate behaviors in the workplace and the role of qualified immunity, specifically in a law enforcement agency; and the current state of collective bargaining and its role in attracting and retaining qualified employees. The purpose of the presentation will be to provide guidance regarding how our officeholders should respond to minimize the risk of liability and place the office in the best position for long-term success.
